These Terms of Service (“Terms”) govern your use of Home Answers, a service operated by Leadstream LLC (“Home Answers,” “Leadstream,” “we,” “us,” or “our”).
By accessing our website, submitting information, using our calculators or forms, purchasing leads, or otherwise using our services, you agree to these Terms.
1. About Home Answers
Home Answers operates a lead-generation and referral service that helps connect homeowners seeking HVAC-related services with independent HVAC contractors.
Home Answers may provide informational tools, including repair-cost estimators, questionnaires, and other resources designed to help homeowners better understand potential HVAC service needs.
Unless expressly stated otherwise, Home Answers does not itself perform HVAC inspections, diagnoses, repairs, installations, or replacements.
HVAC contractors participating in the Home Answers network are independent businesses and are not employees, agents, or representatives of Leadstream LLC.
2. HVAC Estimates and Information
Any repair or replacement estimate displayed through Home Answers is provided for general informational purposes only.
Estimates may be based on information supplied by the homeowner, including reported symptoms, equipment type, equipment age, system condition, urgency, and other factors.
These estimates:
Are not guaranteed quotes.
Do not constitute an HVAC diagnosis.
May differ substantially from the actual cost of service.
Do not replace an in-person inspection by a qualified HVAC professional.
The contractor performing the service is solely responsible for determining the actual diagnosis, recommended repairs, pricing, warranties, and terms of service.
3. Homeowner Service Requests
When a homeowner submits a request through Home Answers, the homeowner authorizes us to use and share the information necessary to respond to that request with participating HVAC contractors.
This may include information such as:
Name
Phone number
Email address
ZIP code or service area
HVAC system information
Reported HVAC problem
Urgency
Other information provided through our forms or questionnaires
Submission of a request does not guarantee that a contractor will accept, respond to, or perform the requested service.
4. Independent HVAC Contractors
HVAC contractors receiving leads through Home Answers operate independently.
Home Answers does not control and is not responsible for a contractor's:
Workmanship
Licensing
Insurance
Pricing
Availability
Recommendations
Warranties
Conduct
Contracts with homeowners
Homeowners should independently evaluate any contractor before authorizing work.
Any agreement for HVAC services is between the homeowner and the contractor providing those services.
5. Contractor Lead Services
HVAC contractors may purchase or otherwise receive leads through Home Answers.
Lead pricing, quantity, service areas, lead qualifications, replacement or credit policies, and other commercial terms may be communicated separately during contractor onboarding or through a separate agreement.
Unless otherwise agreed in writing, purchasing a lead does not guarantee:
That the homeowner will answer the phone.
That the homeowner will schedule an appointment.
That a sale will occur.
Any particular revenue or return on investment.
Contractors are responsible for timely follow-up and for complying with all applicable laws when contacting homeowners.
6. Payments
Certain Home Answers services may require payment.
Payments may be processed through third-party payment processors. By making a purchase, you authorize the applicable charges disclosed at the time of purchase.
Except where otherwise stated in an applicable lead-credit or refund policy, payments may be non-refundable once services or leads have been delivered.
7. SMS Lead Notification Program
Home Answers, operated by Leadstream LLC, offers an optional SMS program for participating HVAC contractor clients.
Contractors who opt in may receive automated or manually generated text messages notifying them when new HVAC leads are assigned to them.
Messages may include information such as the homeowner's name, phone number, ZIP code, HVAC issue, urgency, and other lead details.
Message Frequency
Message frequency varies depending on the number of leads assigned to the participating contractor.
Messaging Charges
Message and data rates may apply.
Your mobile carrier's standard messaging and data charges may apply to messages sent or received through this program.
Opting Out
You may stop receiving SMS lead notifications at any time by replying:
STOP
After opting out, you will no longer receive SMS messages from this program unless you later opt in again.

Optional Participation
Participation in SMS notifications is optional.
SMS consent is not required to purchase leads or to receive lead information by email when email delivery is otherwise available.
Carrier Liability
Carriers are not liable for any delayed or undelivered messages.
SMS Privacy
Mobile numbers, SMS opt-in information, and SMS consent are handled in accordance with our Privacy Policy.
We do not sell or share SMS opt-in data or consent with third parties or affiliates for their own marketing or promotional purposes.

8. Acceptable Use
You agree not to use Home Answers to:
Submit false or fraudulent information.
Impersonate another person or business.
Attempt to gain unauthorized access to our systems.
Interfere with the operation or security of our services.
Harvest or misuse personal information.
Use leads or contact information for unlawful purposes.
Violate applicable telemarketing, privacy, consumer-protection, or communications laws.
We may suspend or terminate access to our services when we reasonably believe misuse has occurred.
9. Intellectual Property
The Home Answers website, branding, written content, calculators, forms, software, graphics, and related materials are owned by Leadstream LLC or used with permission.
You may not reproduce, distribute, modify, sell, or commercially exploit our materials without prior written permission, except as permitted by law.
10. Third-Party Services
Home Answers may use or link to third-party services, including payment processors, communications providers, HVAC contractors, analytics tools, and other technology platforms.
We are not responsible for the availability, policies, security, or performance of third-party services.
Use of third-party services may also be subject to their own terms and privacy policies.
11. Disclaimer of Warranties
To the extent permitted by law, Home Answers and its services are provided on an “as is” and “as available” basis.
We do not guarantee that:
Estimates will be accurate.
Contractors will be available.
Contractors will respond within a particular period.
Services will meet every user's expectations.
The website or communications will operate without interruption or error.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Leadstream LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of Home Answers.
Home Answers is not responsible for losses arising from the acts, omissions, pricing, advice, workmanship, or services of independent HVAC contractors.
Nothing in these Terms limits rights or remedies that cannot legally be limited.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold Leadstream LLC harmless from claims, damages, losses, liabilities, and reasonable costs arising from your misuse of Home Answers, violation of these Terms, or violation of applicable law.
14. Changes to These Terms
We may update these Terms periodically.
When changes are made, we may update the effective date shown at the top of this page.
Your continued use of Home Answers after updated Terms become effective constitutes acceptance of the revised Terms.
15. Governing Law
These Terms will be governed by applicable United States law and the laws applicable to Leadstream LLC, without regard to conflict-of-law principles.
